My daughter in law got clamped a few days ago whilst visiting her mother who lives in St Jerome's Close, Hayes. She is not happy, especially when you think that she had visited there every day for the past 4 years and never noticed a sign saying it was residents parking only. I have visited a few times and never seen any signs!

Does anyone on here know the legal requirement for signs that warn you could be clamped?

There surely be something other than make it up as you go along, plus in British law, you don't have to prove innocence rather the prosecution does have to prove guilt. ;) ;)

Is St Jeromes Close private property or a public highway ?? as that could make a big difference.

The fact it is a close would suggest it is not a highway, I think it would depend on who issued the PCN a private company or the Council, the idea of PCNs is to keep traffic moving, but in a close? that would blow open the traffic control aspect. lets know! if is obstructing the free movement of traffic then what traffic needs to be identified because as a close suggests there is no through traffic. :roll: :roll:

It is a private road, and the clamping company is a private company. The guidance seems to be that there should be clear and prominent signs, but there are only a few notices saying "residents parking only". Nothing about clamping anywhere as far as I can see.

It should be St Jerome's GROVE (off Judge Heath Lane), not close! :?

I suppose the next thing is to find out who hired them as traffic control, sounds like a cowboy outfit the person who you was visiting is the best bet to contact them, it is a grey area this private land control, mostly ran by cowboys, and even so if clamping is a risk then should have proper signage, as if not then its entrapment, and the legality of it questionable, best I can offer! maybe some of your friends within the council could find out what sort if any mandate they have to operate good luck,as it seems like demanding money with menaces. ;) ;)

there must be signs warning wheel clamping is in operation.
if you want your money back you have to go after the
wheelclampers and landowners at the same time
